State Pollutant Discharge Elimination System (SPDES) General Permit

In compliance with the federal Clean Water Act and New York State Environmental Conservation Law, the  Village of Nyack has developed and implemented a local management plan to help reduce pollutant loading in coastal waters and improve the water quality in our reservoirs.  

Stormwater Management Program (SWMP)


The Stormwater Management Program (SWMP) Plan is a blueprint for the Village, local businesses and residents to use to help prevent contamination of coastal waters and groundwater from pollutants and toxins found in everyday materials, including trash, chemicals, pet waste, grease, oil, cleaners, paints and sediments.  Stormwater carries pollutants from these sources through Nyack's Municipal Separate Storm Sewer System (MS4) where they pose a threat to surface water and drinking water quality.

In New York State, provisions of the Clean Water Act are administered for the U.S. Environmental Protection Agency (EPA) by the NYS Department of Environmental Conservation (DEC). 

DEC uses a document called the State Pollutant Discharge Elimination System Permit to regulate municipal stormwater pollution control activities. The SPDES permit requires that municipal SWMPs address six (6) required control measures designed to limit or eliminate harmful discharges:

• Public Education & Outreach
• Public Participation & Involvement
• Illicit Discharge Detection and Elimination (IDDE)
• Construction Site Runoff Control
• Post-Construction Runoff Control
• Municipal Pollution Prevention/Good Housekeeping
